California Landlord Sentenced To Prison: Asbestos Violations

A California landlord has been sentenced to over one year in prison and three years of supervised release by the Court for violating the federal Clean Air Act during renovations. The landlord pleaded guilty to failing to safely remove asbestos before renovating two apartment complexes.
He admitted to knowing about the asbestos-containing materials and hiring untrained individuals. Under the Clean Air Act, asbestos must be removed before renovations, kept wet, and disposed of properly.
Untrained laborers at both sites didn't use safety measures when removing asbestos. The landlord tried to evade law enforcement by removing dumpsters before inspections and lying about project ownership. Assistant AG Todd Kim emphasized that cutting corners on asbestos abatement won't go unpunished. He stressed the seriousness of the offenses and pledged to continue prosecuting violations of the Clean Air Act's asbestos safety regulations.

The Environmental Consulting Services and Outreach Training Program is a voluntary program. Its purpose is to promote workplace safety and health and to make workers more knowledgeable about workplace hazards like Asbestos testing and their rights. Outreach training does not fulfill the training requirements found in OSHA standards. Certification is required by Title 8, California Code of Regulations, Article 2.6, Section 341.15 for individuals who contract to provide Environmental consulting services, health and safety services for asbestos-related work and air quality permits (projects involving more than 100 square feet of asbestos-containing construction material).

The Bay Area Air District regulates the demolition and renovation of buildings and structures that may contain asbestos, and the manufacture of materials known to contain asbestos.
The Air District must be notified at least 10 business days before:
- Any renovation involving the removal of 100 sq. ft. or more, 100 linear ft. or more, or 35 cubic feet or more of asbestos.
- Every demolition regardless of asbestos content.
For residential buildings of four or fewer dwelling units, you may notify the Air District 72 hours in advance with the payment of an additional fee.
Air District regulations must always be followed when removing asbestos or demolishing buildings.
